Notice to Owner
Under Texas law, any contractor, subcontractor, laborer, supplier, or other person who provides labor or materials to improve your property, but is not paid, has the right to file a lien against your property. This means that after a court hearing, your property could be sold to satisfy unpaid obligations.
To preserve their right to file a lien, certain parties (such as subcontractors or suppliers) may provide you with a “Lien Affidavit.” This is not a lien itself but serves to notify you of potential lien claims. Generally, liens must be filed within 120 days after completion of work.
Responsibilities of customer
The customer agrees to:
Provide reasonable access to the work site.
Bear the cost of any additional work required to bring pre-existing conditions up to code.
Hold Brazos Home Services harmless for issues arising from:
Improper or faulty plumbing
Rusted or defective pipes
Acid or chemical damage in drains
Settled, broken, or collapsed lines
Existing illegal conditions
Faulty electrical or HVAC systems
Mold or moisture-related issues
Defective roofing or structural issues
The customer is responsible for removing or protecting personal property, landscaping, and household items before work begins. Brazos Home Services is not responsible for damage to unprotected property, nor for normal consequences of plumbing work such as disturbance to lawns, driveways, walkways, or other improvements.

– Conditions and Limitations
We will perform all work in a skilled and professional manner, using materials that meet applicable code requirements. We are not responsible for correcting existing illegal or hazardous conditions unless specifically contracted to do so.
Limited warranty
General Warranty: Workmanship and materials provided by Brazos Home Services are warranted to be free from defects for 365 days from completion unless otherwise noted in writing.
Drain Work: Drain stoppages are warranted for 30 days from completion.
Payment Requirement: ALL WARRANTIES ARE VOID IF PAYMENT IS NOT MADE IN FULL WHEN DUE. Unless otherwise agreed in writing, payment is due upon completion of work.
Exclusions: WARRANTY DOES NOT COVER:
WORK PERFORMED BY OTHERS AFTER OUR COMPLETION.
CUSTOMER-SUPPLIED PARTS OR MATERIALS.
MOLD, MOISTURE, OR PRE-EXISTING DEFECTIVE CONDITIONS.
INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING WATER DAMAGE).
CITY TAP, RISER, OR UTILITY CONNECTIONS OUTSIDE THE SCOPE OF REPAIR.
DEFECTS CAUSED BY NEGLECT, MISUSE, OR ALTERATION BY OTHERS.
IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO 90 DAYS FROM COMPLETION.
To request warranty service, notify Brazos Home Services in writing or by phone. Warranty service will be scheduled promptly during normal business hours.
Exclusions & Limitations of Liability
CUSTOMER’S SOLE REMEDIES ARE REPAIR OR REPLACEMENT UNDER THIS LIMITED WARRANTY.
BRAZOS HOME SERVICES IS NOT LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND.
CUSTOMER ACKNOWLEDGES THAT PLUMBING SERVICES MAY INVOLVE RISK OF MOLD EXPOSURE OR GROWTH. BY AUTHORIZING WORK, THE CUSTOMER ACCEPTS THIS RISK AND RELEASES BRAZOS HOME SERVICES FROM MOLD-RELATED DAMAGES.
Protection of customer’s property
Customer agrees to remove or protect any personal property, inside and out, including but not limited to, carpets, rugs, shrubs, and planting, and Brazos Home Services shall not be responsible for said items. Nor shall Brazos Home Services be held responsible for the natural consequences of work which may cause damage to improvements to real property including, but not limited to, curbs, sidewalks walks, driveways, garages, patios, lawns, shrubs, sprinkler systems, and other appurtenances to the residence of other real property. Brazos Home Services shall not be held responsible for damage to personal property, real property, or improvements to real property caused by persons delivering materials or equipment or keeping gates and doors closed for children and animals.
Entire agreement
This document represents the entire agreement between Brazos Home Services and the customer. No oral statements or promises not included herein are binding. This agreement applies to the customer and their heirs, representatives, successors, and assigns.
Flat Rate Pricing Policy
For flat-rate services, pricing is presented as a total project cost. Itemized breakdowns of labor and overhead are not provided. Upon request, we will supply an itemized list of materials used in the repair.
Payment Terms
Payment is due in full upon completion of work unless otherwise agreed in writing by Brazos Home Services. If payment is not made when due, all warranties are void. Unpaid balances are subject to collection, and the customer agrees to pay reasonable attorney’s fees, court costs, and collection expenses incurred by Brazos Home Services.
Venue and Jurisdiction
This agreement shall be governed by the laws of the State of Texas. Any legal action arising out of this agreement shall be brought exclusively in the courts of Harris County, Texas, or Montgomery County, Texas. The parties consent to the jurisdiction of such courts.
Texas Property Code Notice
This contract is subject to CHAPTER 27 OF THE TEXAS PROPERTY CODE. If you believe there is a construction defect that has not been resolved through normal warranty service, you must provide written notice by certified mail, return receipt requested, at least 60 days before filing suit or arbitration. The notice must reference Chapter 27 and describe the alleged defect. Upon request, the contractor must be allowed to inspect and, if necessary, cure the defect as provided by law.
